| That the incubent shall apply by way of an application letter starting His/Her willingness & acceptence of the terms & conditions laid herein after. |
| That the company invites application from the applicant on a clear understanding that such joining and/or purchase of the products is free from coercion, undue influence, allure, solicitation, inducement or misled or by any force. The applicant shall join only out of his free will and clear mind. |
| Advance payment made by newly appointed independent representatives for enrollment towards purchasing one of the products among the various products/services offered shall not be refunded under any circumstances. |
| D.A. Marketing Pvt.Ltd. herein after called the company recognizes the sponsor as shown on the files entered ,by may of original application submitted and signed by the applicant and entered into records of D.A. Marketing Pvt.Ltd. |
| If observed that a guest of any other independent representatives is enrolled under the network of another independent representative, the company will revert such enrollment and concerned independent representative shall be held responsible to make good the losses/consequences sustained by the other representatives and/or the company |
| The independent representative shall hand over all the money payable by way of purchasng product/services of the company received as advance from the new representatives to the company or authorized centers of the company. |
| In the event of death as independent representatives, the rights and responsibilities of the independent representatives are passed on the rightful nominee as per the law.the nominee shall be bourne by the terms & conditions as accepted by the deceased. |
| The independent representatives shall display the company name, logo as designed by the company for printing his/her personal stationary with prior permission. however the associate shall not use the trademark, patent,or any other intellectual properties of the company for any other purpose other than for promotion of business of the company,any infringement of part of i.r shall render him liable for damages & losses to the company. |
| The company shall have the right to make any amendments, alterations, deletions in the company rules & regulations and products/services and business plan, etc, if necessary at any time after the agreement and the independent representatives shall be bounded by such changes. |
| Independent representative declares that he/she will pay all types of charges including meeting fees,promotion charges,advertisement pool and event management fees or other types of fees or charges required by the company for the betterment of the program as and when required. |
| the company may terminate the independent representatives withour prior notice on the following grounds:
a) if an independent representative acts against the interest of the company. b) if found any statement of information made in the application to be false or misleading. c) if found involved in any criminal case and or of criminal background or in any fraud with the company. d) if any independent representative represents any other network marketing company engaged to the similar nature of business. e) the right of a terminated representative to receive any divers, (any whatever form) d.a. marketing pvt. ltd. ceases immediately from the date of termination. f) if any independent representative resigned the company.he/she will not be entitled from an kind of benefits from the company from the month of resignation. |
| Any disputes arising out of this agreement or in relation to the agreement shall be referred to a single arbitrator to be appointed by the company independent representatives shall not arise any objection on the ground thet the arbitrator so appointed is a person employed or in connection with the company. |
| That i have understood the terms & conditions stated herein above in the language or languages that i know myself. |
| All disputes shall be subject to delhi jurisdiction only. |
